Why Do I need record expungement?

What is the difference between expungement and record sealing?

Many use these terms interchangeably, but the state of Arkansas only recognizes the term “sealing.” While a sealed criminal record will not be destroyed it will be sealed, making it unavailable on a public record.

What happens after my records are sealed?

The public will be unable to access your criminal record. If an application asks that you have been arrested or convicted of a crime, you can legally say no. Background checks will not show a record of conviction.

Are all convictions eligible to be sealed?

No, the following convictions are ineligible: 

  • Sexual offenses with a victim under the age of 18 
  • Class Y felonies
  • Class A or B felonies that are not drug offenses
  • Manslaughter
  • Violent felonies
  • Felonies with a max sentence of 10+ years

The above convictions can only be cleared with a Governor’s Pardon, which is a lengthy process where a pardon is rarely granted. The Governor’s decision is final, and you may not reapply after your application is denied.

What do I need to do to get my record sealed?
